on may 5, 2009, rubio announced on website planned run united states senate seat being vacated mel martínez, had announced not seek reelection. martinez subsequently announced (in august 2009) resign before completing term, , upon resignation replaced george lemieux. prior making may 5, 2009 announcement, rubio had been meeting fundraisers , supporters throughout state. trailing double-digits in primary against incumbent governor of own party, charlie crist, rubio surpassed crist in polling republican nomination. in campaign, rubio received support of members of tea party, many of whom dissatisfied crist s policies governor.


on april 28, 2010, crist announced running without party affiliation, ceding republican nomination rubio.

on november 2, 2010, rubio won general election 49 percent of vote crist s 30% , democrat kendrick meek s 20%. following victory in elections, rubio became subject of speculation potential republican candidate 2012 presidential election. @ time of election, rubio joined bob menendez of new jersey 2 latino americans in senate.
